Purpose of data processing

Profiles of Facilitators / Trainers (natural persons) are created on our platform in order to connect them with companies or individuals (Leads) who are looking for freelancers. The platform is used exclusively for establishing contact between Facilitators / Trainers and interested Leads.

Legal basis and data categories

Your personal data is processed in accordance with Art. 6 (1) (b) and Art. 6 (1) (a) GDPR for the purpose of fulfilling the contract and obtaining consent for the publication of photos and profile information.

We process at least the following categories of data

• Surname, first name

• Email address

• Specialisation

• Photo (optional)

• Optional information in the free text field

The Facilitator / Trainer’s profile is publicly displayed on the platform. The email address is not publicly displayed.

Recipients

We will process your data exclusively within the scope of the contractual obligations of the concluded contract and, if necessary, transfer it to the following categories of recipients:

• Website management (internal)

• Leads (individuals/companies)

Leads can send a message to the Facilitators / Trainers via AJ&Smart. The Facilitators / Trainers receives the message from AJ&Smart and decides for themselves whether and how to contact the Lead.

‍‍Duration of storage

We only store the data for as long as is necessary to fulfil the purposes pursued. Data that is subject to statutory retention obligations will be deleted after these obligations have expired. Facilitators / Trainers can request the deletion of their profile and all personal data at any time. To do so, simply send an email to AJ&Smart at contact@ajsmart.de. Once the deletion request has been received, the data will be deleted immediately. 

Rights of the data subject

According to Articles 15-22 of the GDPR, you have the following rights if the legal requirements are met: 

Right to: information, correction, deletion, restriction of processing, data portability. Insofar as we base data processing on your consent, you can also revoke this at any time with effect for the future, Art. 7 GDPR. According to Art. 13 No. 2 c) in conjunction with Art. 21 GDPR, you also have a right to object to the processing, which gives you the opportunity to object to the data processing pursuant to Art. 6 para. 1 lit. f) GDPR.

Complaint to the supervisory authority

According to Art. 77 GDPR, you have the right to complain to the competent supervisory authorities if you believe that the processing of your personal data is not lawful.
